Easthampton Clay Waiver Release

This release and waiver of liability executed by (the Member/Student/Parent) of Easthampton Clay, LLC (“the studio”), a limited liability company and ceramics studio as well as Easthampton Clay’s directors, officers, agents, employees, contractors and subcontractors and their respective successors and assigns (the “Released Parties”). Member/Student/Parent desires to be a Member/Student/Parent at Easthampton Clay and desires to participate in the activities related to being an Easthampton Clay Member/Student/Parent. Member/Student/Parent understands that covered activities include any activity Member/Student engages in while on Studio premises, whether related to ceramics work or not. Covered activities include, but are not limited to, working with clay, glazes, pottery wheels, slab rollers, extruders, pottery making tools and other materials found at the studio. Covered activities also include attending classes, workshops, exhibitions, open studio time or socializing with other students on the premises.

Member/Student/Parent with full knowledge of his or her rights does hereby freely, voluntarily and without duress execute this Waiver and Release under the following terms:

Waiver and Release:

Member/Student/Parent does hereby release and forever discharge and hold harmless the Released Parties from any and all liability, claims, damages, and demands of whatever kind or nature, either in law or equity, which arise or may hereafter arise from Member/Student/Parent activities at or in conjunction with Easthampton Clay. Member/Student/Parent understands that this release discharges the Released Parties from any liability or claims that Member/Student/Parent may have against the Released Parties with respect to bodily injury, personal injury, illness (Coronavirus), death or personal property damage that may result from Member/Student/Parent’s at or in conjunction with Easthampton Clay, whether caused by the negligence of the Released Parties or otherwise. Member/Student/Parent also understands that Released Parties do not assume responsibility for or obligation to provide financial assistance, including but not limited to medical, health, or disability insurance. Without in anyway limiting the foregoing, or any other provision of this Release and Waiver liability. Member/Student/Parent expressly agrees that no event shall Member/Student/Parent look to the insurance carried by any contractor or subcontractor engaged by Easthampton Clay LLC in connection with any liability, claims, damages or demands asserted by Member/Student/Parent.

Individuals registering on behalf of a private party/group must acknowledge that they’re signing a waiver on behalf of their entire group.

Medical Treatment:

Member/Student/Parent does hereby release and forever discharge the Released Parties from any claim whatsoever which arises or may thereafter arise on account of any first aid, treatment, or service rendered in conjunction with Member/Student/Parent’s participation, activities at or in conjunction with Easthampton Clay or with the decision by any representative or agent of Easthampton Clay to exercise the power to consent to medical or dental treatment.

Assumption of the Risk:

Member/Student/Parent understand that, in the course of their membership/class, Member/Student/Parent may participation in activities that may be hazardous to Member/Student/Parent and that some tools, materials and machinery of the Easthampton Clay premises may be beyond the control of Easthampton Clay and the other Released Parties. Member/Student/Parent hereby expressly and specifically assumes the risk of injury or harm in the activities of Member/Student/Parent’s participation in activities at Easthampton Clay.

Insurance:

Member/Student/Parent understands that the Released Parties do not carry or maintain any medical, health or disability insurance coverage for any Member/Student/Parent.

Other:

Member/Student/Parent expressly agrees that this release is not intended to be as broad and inclusive as permitted by the laws of the State of Massachusetts, and that this Waiver and Release shall be governed by and interpreted in accordance with the laws of the State of Massachusetts. Member/Student/Parent agrees that in the event that any clause or provision of this Waiver and Release shall be held invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Waiver and Release which shall continue to be enforceable. Member/Student/Parent shall abide by studio policies as stated on the EHC website, www.easthamptonclay.com.

Covid 19 Addendum:

With the Omicron variant upon us, infection rates in our area have gone up. 
Here's what we're doing to maintain safety:

  • The studio has two large EnviroKlenz air filtration systems; one for the members room area and one for the class area. These air filtration systems are hospital grade and are equipped with HEPA filters and a virus killing UVC function. 

  • In addition, we have intake and exhaust fans for fresh air exchange at our windows.

  • The air filters in the air purifiers have been recently changed just before our holiday break.

  • Hanging soap dispensers have been hung in the studio and we are requiring that everyone wash their hands when they come into the studio.

  • Bottles have been filled with alcohol for disinfecting high touch areas such as sinks knobs, light switches, etc and for use by all people in the studio.

  • If anyone tests positive, we will alert those they've been in contact with and we will step up cleaning.

Here's what we need you to do to keep us all safe:

  • As of January 10th, we are requiring all students and members of Easthampton Clay to be vaccinated for Covid-19.   Note that we are only requiring at least one vaccination at this time but we will be looking for both vaccines and a booster in the future.

  • A mask MUST be worn at all times while in the studio and building. The only approved face masks for the studio will be N95, KN95, or surgical masks. You're welcome to wear these under or over your cloth face masks but not necessary to wear both cloth and surgical masks.  Please reach out to us by email if you have any questions.

  • Valve masks are not permitted.

  • Please do your best to maintain a safe distance from your studio peers.

  • Face shields are not required at this time, but if you feel more comfortable with a face shield, they are available in the studio for $5 each, payable by Venmo, PayPal, or cash.  Please note that face shields are not to replace a mask.

  • If you have tested positive for Covid, please let us know immediately for contact tracing purposes.
